21 August, 2003 Craig Dewick, 9 McKell Avenue, Waterfall, NSW 2233 Our Ref: RMD:KEP:JLB:990368 Re: Transfer of ownership of 'correctscientology.info' and 'scientology.com.au' Dear Mr Dewick, We act for the Religious Technology Centre (hereinafter referred to as "our client"). Our client informs us that they have been in correspondence with you via their US based attorneys in related to your registration of the 'scientology.com.au' and 'correctscientology.info' domain names and subsequent diversion of Internet users who access these domain name addresses to your site at 'bsdf.info' We have recently been advised by our client's US attorneys that no active website or hyperlink is currently being provided at the 'correctscientology.info' and 'scientology.com.au' domain name addresses. As you are aware, our client has registered trade mark rights in Australia and numerous countries overseas covering a wide range of goods and services for the "SCIENTOLOGY" trade mark. In addition, our client has established a substantial reputation in the "SCIENTOLOGY" trade mark through its extensive use on a worldwide basis. In view of the above, we trust that this matter may be resolved without resorting to any legal action. Accordingly, we are instructed to request that you provide the following undertakings: (a) transfer the domain name registrations 'scientology.com.au' and 'correctscientology.com.au' to our client and provide us with all relevant documentation in order to facilitate the transfer of these domain names within seven (7) days from the date of this letter; and (b) to refrain from registering any domain name in the future which incorporates the trade mark "SCIENTOLOGY" or any word which is substantially identical with, or deceptively similar to the "SCIENTOLOGY" trade mark. The above undertakings may be given by returning a signed copy of this letter to the above address by 12.00pm on Monday, 25 August 2003. As you can see, it was next to impossible to get a printed written reply sent back to the firm by the deadline as the letter arrived on the same morning as the day of their deadline! Their haste to grab back the domain names by intimidating me caused them trip over their own footsteps...
